A Living Trust is an estate planning tool which has gained a great deal of favor for the following reasons:

  1. Unlike a Will, which becomes a public document once filed with the court, a Trust is a confidential, private document.
  2. A Trust is generally revocable and amendable without all the formality of signing a Will.
  3. A properly written Trust will generally avoid your heirs having to go to probate court when you pass away.
  4. A Trust becomes effective upon signing and may allow for your assets to be managed by someone other than you even prior to your death, such as upon your incompetency.
  5. A Trust may be revocable or irrevocable
